Garbage Rules

December 1, 2010

Fellow Fairwood West Residents,

Re: Garbage Cans, Recycle Containers and Yard Waste Bins

The Board of Trustees requests your help in maintaining the pleasant appearance of your community. You may not be aware that leaving garbage cans, recycle containers and yard waste bins visible from the street on your driveways or in side yards for extended periods is a practice that violates the Covenants, Conditions and Restrictions (CC&Rs) of the Fairwood West HOA.

We request that garbage cans, recycle containers and yard waste bins be stored in your garage or in your side yard behind a suitable screen so that they are not visible from the street.

The Fairwood West HOA CCRs state:

ARTICLE VIII Exterior Maintenance

Section 2. Individual Lots.

Each individual lot owner or contract purchaser shall be obligated to provide exterior maintenance no his/her/their own lot. No lot or tract shall be used as a dump for trash or rubbish of any kind.

Household trash, lumber, building materials, vehicle parts, abandoned or broken equipment, grass clippings, branches and other yard refuse may not be left on front or side yards, sidewalks, streets or other areas where they are visible from the street.

Section 3. Enforcement.

Enforcement of the provisions of Section 2 above shall be in accordance with the provisions of ARTICLE XIII, Section 3.

In addition, Waste Management (WM), the company that services our area, requests the following:

1. Please place containers at the curb by 6:00 a.m.

2. Two (2) feet apart with lids opening toward the street.

3. At least three (3) feet from cars, trees, mailboxes.

4. Wheels as close to the curb as possible

5. Please remove containers as soon as possible after collection.

The Board of Trustees suggests that on the evening (6:00 p.m. or later) prior to the scheduled pick-up day you place your containers at the curb per WM instructions. We request that all containers be returned to their designated storage site no later than 6:00 p.m. on the day of service.

Thank you for your cooperation.
